What are my rights when I book a holiday?

You and your agent will have specific rights under the terms and conditions of the contract into which you enter. It is your responsibility to read and understand those terms and conditions. All ATAS travel businesses are obliged to adhere to the ATAS Code of Conduct, which sets standards that must be met. You can find out more about the code obligations here.

You also have rights under Australian Consumer Law, which protects you, as the consumer, when buying goods and services, including travel, under a range of consumer guarantees.

For example, the business must:

  • Provide services with due care and skill;
  • Supply products of acceptable quality and that match the description (for example, in a tour brochure or what a business tells you about a particular place or tour);
  • Supply products and services that are reasonably fit for the purpose you specify.
